Dallas, Texas — 1000Bulbs.com, one of America’s largest online retailer for LED bulbs, fixtures, and lighting supplies, has initiated legal proceedings against 1000 LED Inc. in both Federal District Court (Texas) and the United States Patent & Trademark Office (USPTO).
On March 28, 2019, 1000Bulbs filed a complaint for trademark infringement and unfair competition against 1000 LED Inc., which purportedly runs the website 1000LED.com. The complaint alleges that 1000 LED Inc. has no employees and is being improperly operated as a shell by other entities controlled by Changyong (Leo) Zhu, including WSD LED Inc., Wisdom Optoelectronics Technology Co., Ltd. and Aluush LLC. In its complaint, 1000Bulbs.com asserts that the defendants, by adopting and selling products under the 1000LED name, are infringing 1000Bulbs’s trademark rights and unfairly competing in the marketplace. In addition to monetary damages and an injunction, the complaint seeks formal cancellation of a trademark registration for “1000LED” obtained by fraud, including the submission of false statements to the USPTO to improperly secure the registration. In addition to the Federal complaint, 1000Bulbs filed complaints in the USPTO to oppose/cancel 1000 LED Inc.’s illegal use of the names www.1000LED.com and 1000LED, both of which improperly trade off of 1000Bulbs’s success in the marketplace. 1000Bulbs.com is represented in all three proceedings by Radulescu LLP, an intellectual property litigation firm whose attorneys have litigated more LED patent infringement cases than any other firm in the country.
