Both Clear-Vu and Kenall have sent us separate press releases regarding their settled litigation. If you look at the Kenall headline, it looks like everyone lived happily ever after. Maybe not. The Kenall release says both companies have agreed to dismiss their ongoing litigation, stating that Clear-Vu Lighting has ceased offering for sale all products using visible light disinfection technology.
The Clear-Vu release states, “While Clear-Vu has not previously sold and does not have any current plans to sell products incorporating this technology, Clear-Vu is empowered with a go-forward right to bring such products to market as the result of the invalidation and a legal settlement with Kenall.”
The Kenall statement implies that the settlement was reached because Clear-Vu ceased offering for sale all products using visible light disinfection technology. The Clear-Vu statement implies that they invalidated the patent.
