On January 10, 2020, Jiaxing Super Lighting Electric Appliance Co., Ltd. together with its U.S. affiliate, Obert, Inc. (“Super Lighting”) filed a patent infringement lawsuit in the United States District Court for the Western District of Texas against two lighting companies: CH Lighting Technology Co., Ltd. (“CH”) and Shaoxing Ruising Lighting Co., Ltd. (“Ruising”), and also against a distributor of the accused lighting products named Elliott Electronic Supply (“Elliott” and collectively all three are the “defendants”).
In the lawsuit, Super Lighting alleges that CH, Ruising, and Elliott are making, using, importing, selling, and/or offering for sale numerous LED linear tube lamps thatinfringe four of Super Lighting’s patents that cover LED tube structure, package, and driver technology: U.S. Pat. Nos. 10,426,003; 10,295,125; 10,342,078; and 10,352,540. In particular, the accused products include at least CH Lighting By Pass Single & Double-input NEW CH1152S Series, CH Lighting By Pass Single & Double-input New CH1152AS Series, CH Lighting By Pass T8 Sign light CH1180AX Series, CH Lighting Dual Mode Tubes NEW CH1157S Series, and other similar products. Super Lighting seeks monetary damages and injunctive relief against all three defendants.
Zhejiang Super Lighting has been a commercial and industrial indoor lighting manufacturer since its establishment in 1993. It provides a full range of energy-saving lighting products from fluorescent lamps to LED lamps. Its subsidiary, Jiaxing Super Lighting invests heavily in the design and development of innovative, high-performance LED linear tube lamps and other lamps, and as a result, Super Lighting has more than 700 issued and pending patents worldwide.
CH is a manufacturer of LED linear tube lamps. Prior to this lawsuit, Super Lighting sent three written notices to remind CH to cease its infringement (through designing around or negotiating a resolution). CH, however, repeatedly ignored and never responded to these notices. CH’s refusal to even respond to these correspondences left Super Lighting with no choice but to file its lawsuit to stop the defendants from their unauthorized use of Super Lighting’s patented technology.
